Although many companies do so simply to meet their legal obligations, the fact that enforcement is often weak may seem at first to provide an argument for not doing so. However, non-compliance exposes a business to risks beyond financial penalties. It can cause reputational damage affecting staff, consumer and shareholder confidence, reduce market opportunities and affect the bottom line.
The EU Packaging Directive aims to prevent packaging waste and promote its reuse, recovery and recycling. Implementation and enforcement vary between EU Member States. In the UK, for example, the design and composition requirements of the Directive are transposed in The Packaging (Essential Requirements) Regulations 2015 and the recovery and recycling obligations are transposed in The Producer Responsibility Obligations (Packaging Waste) Regulations 2007 as amended.
